 RE: Resolution No. R2022-64 Ratifying the CBA Between the City and IUPA Bargaining Unit (Francisco Rios, Human Resources Director)


Description
 
BACKGROUND ANALYSIS:


 

This Agreement before the Mayor and Commission for final approval and ratification is the product of good faith negotiations between the City and the Union. This Agreement recognizes the services provided by the public servants of this bargaining unit while ensuring the continued delivery of quality services to the residents of City of North Miami Beach. The following is a summary of substantive changes in the new agreement:

 

·         ARTICLE 12: SHIFT EXCHANGE & SUBSTITUTIONS, Section 4

Amends language to read as follows:

The Police Chief or designee, within his/her sole discretion, shall select the first four (4) employees for each shift on a rotating basis. The remaining positions for each shift shall be filled by shift selection on a rotating basis in accordance with seniority. This limit does not apply to K9, FTO, SRT, Motors, discipline, or probationary employees

Previous language allowed for three singular transfers, reassignments or shift changes per fiscal year.

 

·         ARTICLE 16: PROMOTIONS, Section 5 (removed)

Removes section as it is agreed that that the City shall discontinue its designation and use of Police Officers as Corporals.

 

·         ARTICLE 18: HOLIDAYS

Recognizes Juneteenth as a paid holiday for covered employees.

 

·         ARTICLE 20: COMPENSATION

o   Section 3: Adds language confirming agreement that the City shall discontinue its designation and use of police officers as corporals.

o   Section 4:

§  Increases eligibility for special assignment allowances from two (2) to three (3).

§  Adds Riot Team and Social Media as special assignments

§  Updates changes to special assignment allowances as indicated below:

Detectives/Street Crimes       $2530.00/week

Field Training Officer             $2025.00/week*

K-9 Team Member                 $1020.00/week

SRT                                         $1020.00/week

Motor Unit                               $1020.00/week

§  Amends language to provide that Field Training Officers (FTOs) and Communications Training Officers (CTOs), engaged in active training of a probationary police or communication officer for a minimum of five (5) hours in a single shift, shall receive additional differential pay in the amount of twelve percent (12%) of their base pay for the entire shift. The 12% differential was previously applied on an hour for hour basis.

·         ARTICLE 21: GROUP INSURANCE, Section 1

Removes table that references outdated contribution rates.

·         ARTICLE 22: LEAVE

o   Section 2, LONGEVITY LEAVE and PAYMENT

Updates the longevity payment schedule as indicated below:

o   Section 7, SICK LEAVE ACCUMULATION & CONVERSION: 

§  Updates language to allow for covered employees to receive 100% of accrued sick leave (up to respective caps) after attainment of over 20 years of service & retirement

·         ARTICLE 25: UNIFORMS, SUPPLIES & EQUIPMENT, Section 1

Amends language to clarify level of ballistic vest that shall be provided.

 RECOMMENDATION:


 

It is recommended that the Mayor and Commissioner approve and ratify the attached 2021-2024 Collective Bargaining Agreement between the City of North Miami Beach and the International Union of Police Associations, AFL-CIO, Local 6005, Bargaining Unit.


On April 7, 2022, the City was notified that the IUPA membership ratified the attached agreement with a vote of 82 in favor and 4 opposed.

 FISCAL/ BUDGETARY IMPACT:
 

The Finance Department has identified that the fiscal impact to the City is approximately $1.875 million for the term of the agreement, excluding retirement benefits.
