Description
 
BACKGROUND ANALYSIS:


 The City of North Miami Beach in furtherance of its initiatives to promote public health, safety, and welfare of the residents and business owners proposes this ordinance. Similar ordinances have been adopted by other municipalities in the state throughout the years.  The proposed ordinance requires that storm shutters or any other hurricane protection devices (i.e. wood boards, PVC, metal panels, etc.) which are used to board up windows or sliding glass doors of a habitable structures be designed and installed in accordance with current Florida Building Codes. Installed shutters and devices which impede egress, light, fire access, and/or ventilation in a closed/secured position on occupied buildings or structures after a designated hurricane watch or warning has been terminated will be required to remove such materials within fifteen (15) consecutive days unless: (1) another hurricane occurs during the fifteen (15) day period, at which point the fifteen (15) day period begins anew the day after the hurricane conditions have subsided; or (2)  hurricane or tropical storm watch conditions are predicted to occur within forty-eight (48) hours after the fifteenth (15) day. The penalty for any person, firm, corporation or agent who violates any provisions of the Ordinance may, upon conviction, be punished by a fine not to exceed $500.00.
 RECOMMENDATION:


 It is recommended that the Mayor and City Commission amend Chapter IX of the Code of Ordinances of the City of North Miami Beach, Florida, to create Section 9-37 entitled “Storm Shutters Regulations” to establish guidelines for the placement and removal of storm shutters subsequent to a hurricane.
