| | BACKGROUND ANALYSIS:
| BACKGROUND:
The applicant, Jeffrey Bercow, Esq., representing 163 ST Executive Center, LLC, request four (4) non-use variances and site plan approval in order to construct a mixed-use development project. The project consists of one (1) nineteen-story tower with a total height of 224’-0” and approximately 448,653.34 square feet of gross floor area. In total, the project will provide 341 residential units, 12,635 square feet of retail space, and 405 parking spaces.
THE SITE:
The subject property is currently a vacant lot. Prior to 2018 there stood a vacant commercial building on the 0.86-acre lot.
APPLICATION SUMMARY:
The proposed development is seeking approval for the following land use entitlements from the City:
- Site Plan: PZB & City Commission Approval Required
- Four (4) Non-Use Variances: PZB & City Commission Approval Required
CITY OF NORTH MIAMI BEACH STRATEGIC PLAN CONSISTENCY:

| RECOMMENDATION:
| PLANNING AND ZONING BOARD RECOMMENDATION:
The Planning and Zoning Board recommended APPROVAL of the Site Plan and Four (4) Non-use variances:
- Motion made at 9:10 pm by Robert Dempster, seconded by Joseph Litowich to approve the first variance of a 0 feet tower setback. Motion approved 6-0.
- Motion made at 9:12 pm by Joseph Litowich, seconded by Robert Dempster to approve the second variance for the screening of the garage. Motion approved 6-0.
- Motion made at 9:13 pm by Joseph Litowich, seconded by Donard St. Jean to approve the third variance to permit 740 square feet cumulative average for all dwelling units. Motion approved 5-1.
- Motion made at 9:15 pm by Robert Dempster, seconded by Marc St. Vil to approve the fourth variance of ‘3 feet 10-inch’ sidewalk on public right of way. Motion approved 6-0.
- Motion made at 9:18 pm by Robert Dempster, seconded by Daniel Heisler to approve the Skygarden site plan. Motion approved 5-1.
COMMUNITY DEVELOPMENT DEPARTMENT RECOMMENDATION:
The Community Development Department recommends APPROVAL of the site plan and four (4) non-use variances subject to the conditions contained in the attached draft Resolution.
