BACKGROUND ANALYSIS:


 

APPLICATION SUMMARY:

The applicant, City of North Miami Beach, requests amendments to the Comprehensive Plan and Land Development Code in order to expand mixed-use development that are of appropriate intensity, density, land use mix, and urban design to foster change in lifestyle, public open spaces, and increase the viability of pedestrian, bicycle and multi modal transportation.

 

 

SECOND READING UPDATE:

The NMB City Commission voted for approval of both ordinances at first reading. Between first and second reading of the ordinances, the amendments to the comprehensive plan and zoning code and associated maps, are required by state statute to be transmitted to the agencies below for comment:

 

Agencies Contacted 11/4/2020:

1.    Florida Department of Economic Opportunity, Bureau of Comprehensive Planning (State Land Planning Agency)

2.    South Florida Regional Planning Council

3.    South Florida Water Management District

4.    Miami-Dade County

5.    FDOT District 6

6.    Florida Department of Environmental Protection

7.    Florida Department of State

8.    Florida Department of Education

 

All agencies may submit comments to the State Land Planning Agency within 30 days of receipt of the transmittal. On the 30th day, the State Land Planning Agency shall issue a letter with comments and instructions for action on the proposed amendment.

 

Comments Received:

1. Florida Department of Economic Opportunity, Bureau of Comprehensive Planning: No comment on the proposed amendment.

 2. South Florida Water Management District: There appear to be no regionally significant water resource issues; therefore the District forwards no comments on the proposed amendment package.

 3. FDOT District 6: The District reviewed the amendment package per Chapter 163 Florida Statutes and found the proposed amendment would not adversely impact transportation resources and facilities of state importance. In addition, the District recommends that the City continue to identify, address the needs of all modes of travel, including public transportation. The District encourages the City to include pedestrian and bicycle facilities, to promote a walkable and connected community consistent with ss. 163.3177, Florida Statutes.

 4. Florida Department of Environmental Protection: The Department has found no provision that, if adopted, would result in adverse impacts to important state resources subject to the Department's jurisdiction.

 

Summary of Request:

• Creating Section 24-58.8 to establish and include regulations for the Mixed-Use International Boulevard West and East, MU/IB-West and MU/IB-East (Exhibit 1)

• Amending Section 24-58.3 to expand and establish regulations for Mixed-Use neighborhood Center District (MU/NC) (Exhibit 2)

• Provides regulations and sub area regulating plans, street network connectivity regulating plans, building height regulating plans for each Mixed-Use District. 

 RECOMMENDATION:


 

CITY COMMISSION RECOMMENDATION (FIRST READING):

At the October 22, 2020 meeting, the City Commission APPROVED the ordinance title at first reading.

 

PLANNING AND ZONING BOARD RECOMMENDATION:

At the August 10, 2020 Planning and Zoning meeting the board recommended APPROVAL by a vote of 4-1.  

 

COMMUNITY DEVELOPMENT DEPARTMENT RECOMMENDATION: 

The Community Development Department recommends APPROVAL of the attached draft ordinances. 

 FISCAL/ BUDGETARY IMPACT:
 None.
