RE: Ordinance No. 2018-14 Amending Chapter II of the Code of Ordinances of the City of North Miami Beach (Second and Final Reading) (Sarah Johnston, City Attorney)
BACKGROUND ANALYSIS:

The City of North Miami Beach (“City”) is currently governed by the State of Florida Code of Ethics for Public Officers and Employees and the Miami-Dade County Conflict of Interest and Code of Ethics ordinance which establish minimum standards of ethical conduct and behavior for elected officials, public employees, members of boards and committees.

 

Many cities in Miami-Dade County and throughout the State of Florida have determined that stricter standards are necessary to address their concerns and the City seeks to promote personal integrity, honesty and ethical conduct in all activities undertaken by public officials and employees.

 

Enactment of a new Code of Ethics will enhance public confidence in City government and will assist in assuring the public that the public officials and employees are faithful stewards of the public trust. Over the course of the last eleven (11) months the Mayor and Commission have held a series of workshops and meetings to discuss and formulate the proposed Code of Ethics. 

 

The proposed Code of Ethics will be effective December 31, 2020 to ensure there is adequate time for implementation and educating those impacted by the additional requirements.  In addition to non-substantive format and language changes, the Code of Ethics includes additional disclosure requirements, clarification to the existing gift prohibitions and exceptions, identifies certain appearances that are prohibited, limits a campaign consultant from lobbying the City for twelve (12) months after the election, modifies the applicable cone of silence, requires lobbyist sign in sheets, requires a travel policy for elected officials and a charitable expenditure and solicitation policy for elected officials, requires training for employees, board/committee/commission members, charter officers, and elected officials, provides penalties and gives the Miami Dade Commission on Ethics jurisdiction for enforcement in accordance with the County Code Section 2-1074 procedures.
