On March 21, 2017, the City Commission approved, on first reading, Ordinance No. 2017-4, which provides for an alternative process for appointments to the Public Utilities Commission and Planning & Zoning Board when there is a vacancy on either board. During public comment and discussion, the City Commission expressed a desire to adopt the same process for the Code Enforcement Board (“CEB”).
The CEB has advisory responsibilities which are integral to the productivity and efficient functioning of the business of the City. The membership, quorum, and appointment process of the CEB is provided in Chapter XIV Building and Housing, of the City’s Code of Ordinances, under 14-8.13 “Code Enforcement Board; Organization; Special Magistrates.”
The proposed amendment provides that upon a vacancy on the CEB and notice to the appointing Commissioner, if no nomination is made after two (2) regularly scheduled City Commission Meetings, the majority of the City Commission may nominate a member for appointment. This proposed amendment is in accordance with the Citizens Bill of Rights, to promote the orderly, efficient, and fair operation of government and adoption is recommended.
